Quantum Law will advise companies on avoidance of litigation claims brought through Occupational/industrial diseases onsite. For example, if the working environment is very noisy, it is the employer’s duty to reduce the noise to an acceptable level or, if this is not possible, to provide staff with ear defenders to prevent Industrial Deafness or Noise Induced Hearing Loss.
As long as the employer provides staff with these ear defenders, it is their responsibility to wear them.
If the job brings staff into contact with dangerous chemicals the employer should have already investigated the possibility of replacing the dangerous chemicals with less harmful ones and ensured that staff have the minimal amount of contact with them as possible.
Quantum Law will advise companies on Health Surveillances. If the employer has concluded that there is no way around staff working with the dangerous chemicals, they should then provide staff with protective clothing to wear. Again, it is staff responsibility to wear the protective clothing once it has been provided.
